When you use our app, we collect personal data about you.\n<br><br>\n2. Personal data is all data that relates to you personally. For example, your name, location data, IP address, device ID, SIM card number, address and email address are personal data. Your fingerprint, images, films, audio recordings, and also your user behavior fall into this category.\n<h4>Legal basis for data processing<\/h4>\n1. By law, any processing of personal data is generally prohibited and is only permitted if the data processing falls under one of the following justifications:\n<br><br>\n<ul>\n \t<li><strong>Art. 6 (1) (a) GDPR (\"Consent\"):<\/strong> Where the data subject has freely indicated, in an informed and unambiguous manner, by a statement or by a clear affirmative action, his or her consent to the processing of personal data concerning him or her for one or more specific purposes.<\/li>\n \t<li><strong>Art. 6 Paragraph 1 Sentence 1 Letter b GDPR:<\/strong> If processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.<\/li>\n \t<li><strong>Art. 6 Paragraph 1 Sentence 1 Letter c GDPR:<\/strong> If processing is necessary to fulfill a legal obligation to which the controller is subject (e.g. a statutory retention period).<\/li>\n \t<li><strong>Art. 5 Paragraph 1 Sentence 1 Letter d GDPR:<\/strong> Where processing is necessary to protect the vital interests of the data subject or of another natural person.<\/li>\n \t<li><strong>Art. 6 Paragraph 1 Sentence 1 Letter e GDPR:<\/strong> If processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.<\/li>\n \t<li><strong>Art. 6 (1) (f) GDPR (\"Legitimate Interests\"):<\/strong> If processing is necessary to protect the legitimate interests (in particular legal or economic) of the controller or a third party, unless the interests or rights of the data subject override them (in particular if the data subject is a minor).<\/li>\n<\/ul>\n<br>\nThe storage of information in the end-user's terminal equipment or access to information already stored in the terminal equipment is only permitted if it is covered by one of the following justifications:\n<br><br>\n<ul>\n \t<li><strong>Section 25 (1) TTDSG:<\/strong> If the end user has given his consent based on clear and comprehensive information. Consent must be given in accordance with Art. 6 (1) (a) GDPR.<\/li>\n \t<li><strong>Section 25 paragraph 2 no. 1 TTDSG:<\/strong> If the sole purpose is to carry out the transmission of a message over a public telecommunications network.<\/li>\n \t<li><strong>Section 25 paragraph 2 no. 2 TTDSG:<\/strong> If storage or access is absolutely necessary so that the provider of a telemedia service can provide a telemedia service expressly requested by the user.<\/li>\n<\/ul>\n<br>\n2. For the processing operations we carry out, we state below the applicable legal basis. Processing may also be based on several legal bases.\n<h4>Data collected during use<\/h4>\n1. When you use our service, personal data is collected.\n\n2. We only collect this data if it is necessary for the performance of the contract between you and us (Art. 6 (1) (b) GDPR). We also collect this data if it is necessary for the functionality of the app and your interest in the protection of your personal data does not outweigh it (Art. 6 (1) (f) GDPR), or if you consent to the collection and processing (Art. 6 (1) (a) GDPR).\n\n3. We collect and process the following data from you:\n<br><br>\n<ul>\n \t<li><strong>Audio:<\/strong> Part of using the app is the processing of audio data, in particular your communication with players and all verbal utterances you make while using it. We process all spoken data.<\/li>\n \t<li><strong>Device information:<\/strong> The access data includes the IP address, device ID, device type, device-specific settings and app settings as well as app properties, the date and time of retrieval, time zone, the amount of data transferred and the message whether the data exchange was complete, app crash, browser type and operating system. This access data is processed to enable the technical operation of the app.<\/li>\n \t<li><strong>Data you provide to us:<\/strong> To use the service, you must create a user account. To do this, you must provide at least your login name.<\/li>\n \t<li><strong>Information with your consent:<\/strong> We process other information (e.g. GPS location data) if you allow us to do so.<\/li>\n \t<li><strong>Contact form details:<\/strong> When using contact forms, the data transmitted through them will be processed (e.g. gender, first and last name, address, company, email address and the time of transmission).<\/li>\n<\/ul>\n<br>\n4. If the processing of the data requires the storage of information in your terminal equipment or access to information that is already stored in the terminal equipment, Section 25 Paragraph 1, 2 TTDSG is the legal basis for this.\n<h4>Data storage period<\/h4>\n1. We will delete your personal data as soon as it is no longer required for the purposes for which we collected or used it. As a rule, we store your personal data for the duration of your usage or contractual relationship via the app. Your data is generally stored only on our servers in Germany, subject to possible transfer.\n<br><br>\n2. However, storage may extend beyond the specified period in the event of a (threatened) legal dispute with you or other legal proceedings.\n<br><br>\n3. Third parties employed by us will store your data on their systems for as long as is necessary in connection with the provision of the service to us in accordance with the respective order.\n<br><br>\n4. Legal requirements for the storage and deletion of personal data remain unaffected by the above (e.g. Section 257 HGB or Section 147 AO). If you contact us by email or via a contact form, your email address, your name and all other personal data that you have provided during the contact process will be stored by us so that we can contact you to answer your question.\n<br><br>\n2. We delete this data as soon as storage is no longer required. If there are statutory retention periods, the data will remain stored, but we will restrict processing.\n<h4>Data processing by third parties<\/h4>\n1. Die Einwilligung hat gem. Art. 6 Abs. 1 S. 1 lit. a DS-GVO zu erfolgen;<\/li>\n \t<li><strong>\u00a7 25 Abs. 2 Nr. 1 TTDSG:<\/strong> Wenn der alleinige Zweck die Durchf\u00fchrung der \u00dcbertragung einer Nachricht \u00fcber ein \u00f6ffentliches Telekommunikationsnetz ist;<\/li>\n \t<li><strong>\u00a7 25 Abs. 2 Nr. 2 TTDSG:<\/strong> Wenn die Speicherung oder der Zugriff unbedingt erforderlich ist, damit der Anbieter eines Telemediendienstes einen vom Nutzer ausdr\u00fccklich gew\u00fcnschten Telemediendienst zur Verf\u00fcgung stellen kann.<\/li>\n<\/ul><br>\n<strong>2.<\/strong> F\u00fcr die von uns vorgenommenen Verarbeitungsvorg\u00e4nge geben wir im Folgenden jeweils die anwendbare Rechtsgrundlage an. Eine Verarbeitung kann auch auf mehreren Rechtsgrundlagen beruhen.\n<h4>Bei der Nutzung erhobenen Daten<\/h4>\n<strong>1.<\/strong> Bei der Nutzung unseres Service werden personenbezogene erhoben.\n<br><br>\n<strong>2.<\/strong> Wir erheben diese Daten nur, wenn dies f\u00fcr die Erf\u00fcllung des Vertrags zwischen Ihnen und uns erforderlich ist (Art. 6 Abs. 1 lit. b DS-GVO). Ferner erheben wir diese Daten, wenn dies f\u00fcr die Funktionsf\u00e4higkeit der App erforderlich ist und Ihr Interesse am Schutz Ihrer personenbezogenen Daten nicht \u00fcberwiegt (Art. 6 Abs. 1 lit. f DS-GVO) oder wenn Sie in die Erhebung und Verarbeitung einwilligen (Art. 6 Abs. 1 lit. a DS-GVO).\n<br><br>\n<strong>3.<\/strong> Wir erheben und verarbeiten folgende Daten von Ihnen:\n<ul><br>\n \t<li><strong>Audio:<\/strong> Ein Bestandteil der Nutzung der App ist die Verarbeitung von Audiodaten, insbesondere ihre Kommunikation mit Spielern und s\u00e4mtliche Wort\u00e4u\u00dferungen, die Sie w\u00e4hrend der Nutzung t\u00e4tigen. Wir verarbeiten s\u00e4mtliche gesprochenen Daten.<\/li>\n \t<li><strong>Ger\u00e4teinformationen:<\/strong> Zu den Zugriffsdaten geh\u00f6ren die IP-Adresse, Ger\u00e4te-ID, Ger\u00e4teart, ger\u00e4tespezifische Einstellungen und App-Einstellungen sowie App-Eigenschaften, das Datum und die Uhrzeit des Abrufs, Zeitzone, die \u00fcbertragene Datenmenge und die Meldung, ob der Datenaustausch vollst\u00e4ndig war, Absturz der App, Browserart und Betriebssystem. Diese Zugriffsdaten werden verarbeitet, um den Betrieb der App technisch zu erm\u00f6glichen.<\/li>\n \t<li><strong>Daten, die Sie uns zur Verf\u00fcgung stellen:<\/strong> F\u00fcr die Nutzung des Service ist die Erstellung eines Nutzerkontos erforderlich. Daf\u00fcr geben Sie mindestens Ihren Anmeldenamen an.<\/li>\n \t<li><strong>Informationen mit Ihrer Einwilligung:<\/strong> Sonstige Informationen (z.\u202fB. GPS-Standortdaten) verarbeiten wir, wenn Sie uns dies gestatten.<\/li>\n \t<li><strong>Kontaktformulardaten:<\/strong> Bei der Nutzung von Kontaktformularen werden die dadurch \u00fcbermittelten Daten verarbeitet (z.\u202fB. Geschlecht, Name und Vorname, Anschrift, Firma, E-Mail-Adresse und der Zeitpunkt der \u00dcbermittlung).<\/li>\n<\/ul><br>\n<strong>4.<\/strong> Sofern f\u00fcr die Verarbeitung der Daten die Speicherung von Informationen in Ihrer Endeinrichtung oder der Zugriff auf Informationen, die bereits in der Endeinrichtung gespeichert sind, erforderlich ist, ist \u00a7 25 Abs. 1, 2 TTDSG hierf\u00fcr die Rechtsgrundlage.\n<h4>Zeitraum der Datenspeicherung<\/h4>\n<strong>1.<\/strong> Wir l\u00f6schen Ihre personenbezogenen Daten, sobald sie f\u00fcr die Zwecke, f\u00fcr die wir sie nach den erhoben oder verwendet haben (siehe C. 4., 5., 6.), nicht mehr erforderlich sind. In der Regel speichern wir Ihre personenbezogenen Daten f\u00fcr die Dauer des Nutzungs- bzw. des Vertragsverh\u00e4ltnisses \u00fcber die App. Eine Speicherung Ihrer Daten erfolgt grunds\u00e4tzlich nur auf unseren Servern in Deutschland, vorbehaltlich einer ggf. erfolgenden Weitergabe nach den Regelungen in F. 1., 2. und 3.\n<br><br>\n<strong>2.<\/strong> Eine Speicherung kann jedoch \u00fcber die angegebene Zeit hinaus im Falle einer (drohenden) Rechtsstreitigkeit mit Ihnen oder eines sonstigen rechtlichen Verfahrens erfolgen.\n<br><br>\n<strong>3.<\/strong> Von uns eingesetzte Dritte (siehe F. 1.) werden Ihre Daten auf deren System so lange speichern, wie es im Zusammenhang mit der Erbringung der Leistung f\u00fcr uns entsprechend dem jeweiligen Auftrag erforderlich ist.\n<br><br>\n<strong>4.<\/strong> Rechtliche Vorgaben zur Aufbewahrung und L\u00f6schung personenbezogener Daten bleiben von Vorstehendem unber\u00fchrt (z.\u202fB. \u00a7 257 HGB oder \u00a7 147 AO). Liegen gesetzliche Aufbewahrungsfristen vor, bleiben die Daten zwar gespeichert, aber wir schr\u00e4nken die Verarbeitung ein.\n<h4>Datenverarbeitung durch Dritte<\/h4>\n<strong>1.<\/strong> Es kann vorkommen, dass f\u00fcr einzelne Funktionen unseres Services auf beauftragte Dienstleister zur\u00fcckgegriffen wird. Para ello, deber\u00e1 proporcionar al menos su nombre de inicio de sesi\u00f3n.<\/li>\n \t<li><strong>Informaci\u00f3n con su consentimiento:<\/strong> Procesamos otra informaci\u00f3n (por ejemplo, datos de ubicaci\u00f3n GPS) si usted nos permite hacerlo.<\/li>\n \t<li><strong>Detalles del formulario de contacto:<\/strong> Al utilizar formularios de contacto, se procesar\u00e1n los datos transmitidos a trav\u00e9s de ellos (por ejemplo, g\u00e9nero, nombre y apellidos, direcci\u00f3n, empresa, direcci\u00f3n de correo electr\u00f3nico y la hora de transmisi\u00f3n).<\/li>\n<\/ul><br>\n4. Si el tratamiento de los datos requiere el almacenamiento de informaci\u00f3n en su equipo terminal o el acceso a informaci\u00f3n que ya est\u00e1 almacenada en el equipo terminal, la base legal para ello es el art\u00edculo 25, apartado 1, 2 TTDSG.\n<h4>Periodo de conservaci\u00f3n de los datos<\/h4>\n1. Eliminaremos sus datos personales tan pronto como ya no sean necesarios para los fines para los que los recopilamos o utilizamos. Por regla general, almacenamos sus datos personales mientras dure el uso o la relaci\u00f3n contractual a trav\u00e9s de la aplicaci\u00f3n.
